In Dubai, areas that have been given the freehold designation are eligible for foreign property ownership. In principle, this indicates that international purchasers and expatriates (who do not reside in the UAE) may purchase freehold ownership rights without leasehold rights, usufruct rights, and limitations for up to 99 years.

In Dubai, having a freehold property allows the owner to have total control over both the house and the ground it is built on. The Dubai Land Department (DLD) issues a title deed for the property and registers the buyer’s name as “landowner” in the registry.

The purpose of damages is to compensate each party for any loss suffered as a reason for default by a counterparty to a contract. As per the prevailing law can claim for the amount he/she has paid as:

  • Interest (Contractual Interest plus legal interest)
  • Agent fees;
  • Bank charges;
  • Additional/Extra amount and any other payment he/she has accrued pertaining to the Agreement.
